Fonts.Gr - Άδεια χρήσης Desktop (DTP) γραμματοσειρών

Η παρούσα άδεια χρήσης παρέχεται με τη λήψη (καταφόρτωση) και εγκατάσταση του σχετικού λογισμικού Fonts.Gr (Ελληνική Ψηφιακή Τυποθήκη) στην ηλεκτρονική συσκευή του αδειούχου χρήστη, υπό την προϋπόθεση ότι ο τελευταίος αποδέχεται τους προδιατυπωμένους όρους χρήσης βάσει επιλογής, η οποία είναι ευκρινώς διαθέσιμη σε αυτόν.

Ορισμοί «Γραμματοσειρά» (Font) νοείται αφενός το κωδικοποιημένο λογισμικό που συνοδεύεται από την παρούσα άδεια χρήσης και παράγει ορισμένο σχέδιο και ορισμένη εικόνα όταν χρησιμοποιηθεί με τον κατάλληλο υλικό και τεχνολογικό εξοπλισμό και αφετέρου όλα τα λοιπά δεδομένα, συμπεριλαμβανομένης της τεκμηρίωσης η οποία παρέχεται με το εν λόγω λογισμικό. «Χρήση» νοείται το χρονικά και τοπικά απεριόριστο μη αποκλειστικό δικαίωμα για καταφόρτωση του κωδικοποιημένου λογισμικού των γραμματοσειρών (εφεξής «το λογισμικό»). Ως «Μονάδα εργασίας με νόμιμο δικαίωμα χρήσης» ορίζεται κάθε ηλεκτρονική συσκευή στην οποία μπορεί να καταφορτωθεί το λογισμικό σύμφωνα με τον αριθμό συσκευών (μονάδων εργασίας) που περιέχονται στην αντίστοιχη άδεια.
Έκταση και κόστος της άδειας Κάθε άδεια χρήσης του λογισμικού αντιστοιχεί σε πέντε (5) σταθμούς εργασίας. Ο συνολικός αριθμός των επιθυμητών σταθμών εργασίας, στους οποίους θα εγκατασταθούν οι γραμματοσειρές, επιλέγεται από τον αδειούχο και καταβάλλεται το αντίτιμο της άδειας ή των αδειών που έχουν επιλεγεί. Η ισχύς κάθε άδειας ενεργοποιείται μετά την καταβολή του αντιτίμου, για το οποίο εκδίδεται το αντίστοιχο τιμολόγιο.
Είδος και έκταση της άδειας Με την αποδοχή των όρων χρήσης και την καταβολή του αντιτίμου της άδειας ο χρήστης αποκτά μια (1) χρονικά και τοπικά απεριόριστη, μη αποκλειστική και μη μεταβιβάσιμη άδεια χρήσης του λογισμικού υπό την έννοια ότι αποκτά δικαίωμα αναπαραγωγής και μεταφόρτωσης του ως άνω λογισμικού σε πέντε (5) σταθμούς εργασίας, καθώς και το δικαίωμα χρήσης αυτού με σκοπό την παραγωγή έντυπου ή ψηφιακού υλικού. Η παρουσίαση στο κοινό του παραγόμενου έργου ή προϊόντος επιτρέπεται μόνο για λόγους διαφημιστικής προβολής της επιχειρηματικής δραστηριότητας του αδειούχου στην ιστοσελίδα της επιχείρισης ή στα κοινωνικά δίκτυα.
Πνευματική και βιομηχανική ιδιοκτησία Όλα τα δικαιώματα πνευματικής και βιομηχανικής ιδιοκτησίας επί του λογισμικού και των αντιγράφων των οικείων αρχείων ανήκουν στην δικαιούχο εταιρεία Fonts.Gr (Π. Χαρατζόπουλος και ΣΙΑ Ο.Ε.) βάσει της εθνικής, της ενωσιακής και της διεθνούς νομοθεσίας. Η παραχώρηση άδειας χρήσης δεν συνιστά εκχώρηση των απόλυτων και αποκλειστικών περιουσιακών εξουσιών της εταιρείας Fonts.Gr επί του προστατευόμενου πρωτότυπου λογισμικού. Απαγορεύεται οποιαδήποτε ολική ή μερική αναπαραγωγή, μεταφόρτωση, δημοσίευση, διανομή, παρουσίαση στο κοινό, ψηφιακή διάθεση ή χρήση με κάθε τρόπο και μέσο του προστατευόμενου πρωτότυπου λογισμικού και των αντιγράφων αυτού για εμπορικούς σκοπούς. Ως δημοσίευση νοείται και η διάδοση του περιεχομένου του λογισμικού και των αντιγράφων αυτού από τα μέσα κοινωνικής δικτύωσης. Ως διανομή στο κοινό νοείται η διάδοση των υλικών φορέων που ενσωματώνουν το λογισμικό και τα αντίγραφα αυτού. Ως παρουσίαση στο κοινό και ψηφιακή διάθεση νοούνται οι πράξεις διάδοσης του λογισμικού και των αντιγράφων αυτού στο διαδίκτυο με οποιονδήποτε τρόπο. Επιτρέπεται μόνο η δημοσίευση, διανομή, παρουσίαση ή ψηφιακή διάθεση στο κοινό του έργου ή του προϊόντος που παράγεται με τη χρήση του λογισμικού. Η διενέργεια μιας εκ των ανωτέρω πράξεων συνιστά προσβολή των δικαιωμάτων πνευματικής και βιομηχανικής ιδιοκτησίας της δικαιούχου εταιρείας Fonts.Gr, η οποία δύναται να διεκδικήσει κάθε θετική ή αποθετική ζημία σύμφωνα με τις διατάξεις της ισχύουσας ενωσιακής και εθνικής νομοθεσίας. Η δομή, η οργάνωση και ο κώδικας των γραμματοσειρών συνιστούν επιχειρηματικό απόρρητο της δικαιούχου εταιρείας Fonts.Gr και καλύπτεται από τις υποχρεώσεις εχεμύθειας και μη ανταγωνισμού.
Περιορισμοί της χρήσης Με την παραχώρηση της παρούσας άδειας χρήσης, ο αδειούχος δεν αποκτά δικαίωμα τροποποίησης, προσαρμογής, μετατροπής, μετάφρασης, διασκευής, αλλοίωσης ή αντιγραφής του λογισμικού με οποιονδήποτε τρόπο. Κατ΄εξαίρεση επιτρέπεται η δημιουργία ενός (1) μόνο αντιγράφου ασφαλείας του λογισμικού από τον αδειούχο υπό την προϋπόθεση ότι ασκεί τον έλεγχο επ’ αυτού ώστε να τηρούνται οι όροι παραχώρησης της παρούσας άδειας. Απαγορεύεται ρητά η αναφόρτωση και διάθεση του λογισμικού σε δημοσίως προσβάσιμους διακομιστές (public servers) ή δημοσίως προσβάσιμα αποθετήρια (public repositories), καθώς και η χρήση αυτού ή των σχεδίων που ενσωματώνονται σε αυτό για την εκπαίδευση συστημάτων τεχνητής νοημοσύνης. Απαγορεύεται, επίσης, η διάθεση του λογισμικού ή η παροχή πρόσβασης σε αυτό σε τρίτους μη αδειούχους. Απαγορεύεται ρητά κάθε ενέργεια αποσυμπίλησης ή ανακατασκευής του πηγαίου κώδικα ή του αντικειμενικού κώδικα του λογισμικού, εκτός εάν αυτό επιτρέπεται από ορισμένη εθνική νομοθεσία για τους σκοπούς που αυτή περιγράφει και με τους εκεί αναφερόμενους περιορισμούς. Τυχόν σφάλμα στο λογισμικό αποκαθίσταται από την δικαιούχο εταιρεία Fonts.Gr κατόπιν σχετικής ειδοποίησης από τον αδειούχο. Απαγορεύεται ρητά η αναπαραγωγή, η πώληση, η εκμίσθωση, ο δανεισμός, η διανομή, η παρουσίαση ή η ψηφιακή διάθεση στο κοινό, καθώς και η δωρεάν παραχώρηση σε τρίτο φυσικό ή νομικό πρόσωπο του συνόλου ή τμήματος του λογισμικού με αναλογικά ή ψηφιακά μέσα και με σκοπό την εμπορική εκμετάλλευση αυτού ή του παραγόμενου από αυτό έργου ή προϊόντος. Δεδομένης της μη μεταβιβαστής φύσης της παρούσας άδειας, απαγορεύεται η περαιτέρω παραχώρηση αυτής από τον αδειούχο σε τρίτο φυσικό ή νομικό πρόσωπο. Ο αδειούχος δύναται μόνο να παρέχει εξουσιοδότηση σε προστηθέντα αυτού ή άλλο πρόσωπο συνδεόμενο προς αυτόν με σύμβαση έργου ή εργασίας με σκοπό τη δημιουργία έργου ή προϊόντος με χρήση του λογισμικού που καλύπτεται από την παρούσα άδεια. Εάν ο αριθμός των προσώπων που απαιτείται να προβούν σε χρήση του λογισμικού υπερβαίνει τον αριθμό των ηλεκτρονικών συσκευών (μονάδων εργασίας) που περιέχονται στην άδεια, η περαιτέρω νόμιμη χρήση του λογισμικού είναι δυνατή μόνον κατόπιν σχετικής επέκτασης της εν λόγω άδειας. Η επέκταση της άδειας παρέχεται έναντι πρόσθετης αμοιβής από την δικαιούχο εταιρεία Fonts.Gr κατόπιν σχετικού έγγραφου αιτήματος του αδειούχου, στο οποίο αναφέρεται ο συνολικός αριθμός των μονάδων εργασίας που χρειάζεται να καλύπτει η επέκταση της άδειας χρήσης, (επεξεργαστές, σταθμοί εργασίας, εκτυπωτές ή/και άλλες συσκευές μέσω των οποίων πραγματοποιείται χρήση του λογισμικού). Η παρούσα άδεια δεν επιτρέπει τη διανομή εμπορικών προϊόντων, ηλεκτρονικών βιβλίων (e-book), ηλεκτρονικών εκδόσεων (e-pub) ή ηλεκτρονικών εφαρμογών (Apps) που ενσωματώνουν το λογισμικό Fonts.Gr. Για την έκδοση, καταφόρτωση ή διανομή ηλεκτρονικών βιβλίων, εφαρμογών ή αρχείων για ιστοτόπους και ηλεκτρονικές συσκευές (φορητές συσκευές, ταμπλέτες, έξυπνα κινητά τηλέφωνα κλπ.) που ενσωματώνουν το λογισμικό Fonts.Gr απαιτείται η επέκταση της παρούσας άδειας χρήσης. Τέτοια επέκταση παρέχεται κατόπιν έγγραφης συμφωνίας με την δικαιούχο εταιρεία Fonts.Gr και την καταβολή πρόσθετης αμοιβής. Η παρούσα άδεια δεν επιτρέπει την ενσωμάτωση των γραμματοσειρών σε διαδικτυακό τόπο (site) είτε με τη μέθοδο @font-face CSS, ή μέσω οποιουδήποτε άλλου τρόπου, ή τη χρήση αυτών προς το σκοπό της αποστολής ενημερωτικών μηνυμάτων μέσω ηλεκτρονικού ταχυδρομείου (e-mail newsletters). Η παρούσα άδεια δεν επιτρέπει την ενσωμάτωση των γραμματοσειρών σε εφαρμογές ή παιγνίδια κατάλληλα προς αναπαραγωγή και μεταφόρτωση σε ηλεκτρονικές συσκευές κάθε είδους, σε περιεχόμενο που μπορεί να αναφορτωθεί σε επιγραμμικές πλατφόρμες διαμοιρασμού (ενδεικτικά YouTube, Facebook, TikTok, Instagram κλπ.) ή να μεταδοθεί από τηλεοπτικούς φορείς, καθώς και σε έργα ή προϊόντα που προορίζονται να εξυπηρετήσουν διαφημιστικούς σκοπούς. Τέτοια επέκταση της παρούσας άδειας παρέχεται κατόπιν έγγραφης συμφωνίας με την δικαιούχο εταιρεία Fonts.Gr και την καταβολή πρόσθετης αμοιβής. Τυχόν χρήση των γραμματοσειρών από τον αδειούχο σε λογότυπο, εμπορικό σήμα, διακριτικό τίτλο, συσκευασία προϊόντος ή εμπορικό προϊόν (merchandise) επιτρέπεται μόνον κατόπιν έγγραφης συμφωνίας με την δικαιούχο εταιρεία Fonts.Gr και την καταβολή πρόσθετης αμοιβής.
Παράγωγα έργα Ως παράγωγα έργα ή προϊόντα νοούνται εκείνα που δημιουργεί ο αδειούχος με χρήση του λογισμικού ή αυτόνομου τμήματος αυτού, συμπεριλαμβανομένων των αρχείων EPS, PDF ή ανυσματικών αρχείων γενικότερα ή άλλων ηλεκτρονικών έργων. Τυχόν χρήση των παράγωγων έργων ή προϊόντων από τον αδειούχο υπόκειται στους όρους και τις προϋποθέσεις της παρούσας άδειας. Απαγορεύεται ρητά η εμπορική εκμετάλλευση παράγωγου έργου ή προϊόντος από τον αδειούχο ως αυτόνομο συναλλακτικό αγαθό. Ενδεικτικά απαγορεύεται η πώληση, η εκμίσθωση, ο δανεισμός, η διανομή, η παρουσίαση, η διάθεση στο κοινό ή η δωρεάν παραχώρηση του έργου ή του προϊόντος που συνιστά παράγωγο του λογισμικού που καλύπτεται από την παρούσα άδεια. Τέτοια χρήση είναι δυνατή μόνον κατόπιν έγγραφης συμφωνίας με την δικαιούχο εταιρεία Fonts.Gr και την καταβολή πρόσθετης αμοιβής, άλλως ο αδειούχος ενέχεται για την ανόρθωση κάθε θετικής και αποθετικής ζημίας της δικαιούχου εταιρείας Fonts.Gr.
Περιορισμός της ευθύνης Η δικαιούχος εταιρεία Fonts.Gr δεν ευθύνεται για τεχνικά προβλήματα που τυχόν αντιμετωπίσει ο αδειούχος κατά την αναπαραγωγή, μεταφόρτωση, αναφόρτωση και εν γένει χρήση του λογισμικού που καλύπτεται από την παρούσα άδεια. Ομοίως, ουδεμία ευθύνη φέρει η δικαιούχος εταιρεία Fonts.Gr για πράξεις ή παραλείψεις του αδειούχου, των προστηθέντων αυτού ή τρίτων προσώπων κατά τη χρήση και εφαρμογή του εν λόγω λογισμικού. Η δικαιούχος εταιρεία Fonts.Gr δεν ευθύνεται για την άνευ αδείας, τροποποίηση ή/και προσαρμογή του λογισμικού ή των παράγωγων έργων αυτού από τον αδειούχο ή μη εξουσιοδοτημένα τρίτα πρόσωπα.
Ισχύς Σε περίπτωση μη συμμόρφωσης του αδειούχου με οποιονδήποτε από τους ανωτέρω όρους, η δικαιούχος εταιρεία Fonts.Gr διατηρεί το δικαίωμα να καταγγείλει χωρίς προειδοποίηση την παρούσα άδεια επιφέροντας άμεσα τη διακοπή της χρήσης του λογισμικού. Κάθε παράβαση των όρων της παρούσας άδειας μπορεί να επισύρει αστικές και ποινικές ευθύνες σύμφωνα με την ελληνική νομοθεσία και τις διεθνείς συμβάσεις περί πνευματικής και βιομηχανικής ιδιοκτησίας.
Εφαρμοστέο Δίκαιο – Δωσιδικία Οι όροι της παρούσας άδειας υπόκεινται στις διατάξεις του Ελληνικού Δικαίου. Για οποιαδήποτε διαφορά προκύψει αποκλειστικά αρμόδια είναι τα Δικαστήρια της Αθήνας.

Fonts.Gr - End User License Agreement for Desktop (DTP) fonts

This user’s license is granted upon download and installation of the relevant Fonts.Gr (Greek Digital Type Library) software in the licensee’s electronic device, under the condition that the licensee accepts and adheres to the standard terms of use through a selection method (button) clearly available to the user.

Definitions “Font” means the coded software, which is accompanied by the present user’s license and produces a specific design and a specific image when executed by the appropriate material and technological equipment, as well as all the other data, including the documentation provided with the software in question. “Term” means the period of time during which this user’s license remains in effect. The licensee selects at the appropriate field the duration of the license, which corresponds to the duration of the licensee’s advertising promotion and the desired number of impressions. “Licensed Workstation” means any electronic device to which the software may be downloaded pursuant to the number of workstations included in the relevant license.
Type and content of the license Each software license covers five (5) workstations. The total number of desired workstations, in which the Font will be installed, is selected by the licensee and the fee for the selected license(s) is paid. Each license is activated after payment and the relevant invoice is issued.
Type and extent of the license By accepting the terms of use and paying the license fee, the licensee acquires one temporally and geographically unlimited, non-exclusive and non-transferable license to use the Fonts software for Desktop use, in the sense that s/he acquires the right to reproduce and download the above software to five (5) workstations, as well as the right to use it for the purpose of creating printed or digital material. The public presentation of the created work or product is allowed only for the purpose of promotion of the business activity of the licensee at the business website or the social media.
Intellectual Property All intellectual property rights over the Font software and the relevant files belong to the licensor corporation Fonts.Gr (P. Charatzopoulos & SIA OE) as per the applicable domestic, EU and international legislation. The granting of a user’s license does not constitute a transfer of the absolute and exclusive property rights of Fonts.Gr over the protected original Font software. Any total or partial reproduction, download, publication, distribution, presentation to the public, digital dissemination or use of the protected original Font software and its copies in any manner or form and by any means for commercial purposes is prohibited. Publication includes the act of making the content of the protected software and its copies available to the public through the social media. Distribution means the dissemination of the material object incorporating the protected software and its copies. Presentation to the public means any act of dissemination of the protected software and its copies through the internet in any manner or form. Only the publication, distribution, presentation to the public or digital dissemination of the work or product generated by the licensed Font software is allowed. The performance of any of the aforementioned prohibited acts constitutes a violation of the intellectual property rights of the licensor corporation Fonts.Gr, which may seek damages and restitution in accordance with the applicable EU and domestic legislation. The structure, organization and coding of the Font software constitute a business secret of the licensor corporation Fonts.Gr and are subject to obligations of non-disclosure and non-competition.
Limitations of use By acquiring this user’s license, the licensee does not obtain the right to modify, adapt, alter, translate, re-arrange or distort the software in any manner or form. Notwithstanding the above, the licensee may create a single back up copy of the software, under the condition that the licensee maintains control over the copy in order to guarantee the observance of the terms of the present license. The uploading and dissemination of the software to public servers or public repositories, as well as the use of the software or the designs incorporated in the software for the training of artificial intelligence systems are expressly prohibited. The dissemination of the software or the granting of access to non-licensed third parties is also prohibited. Any act of decompiling or reverse-engineering of the source code or the object code of the software is expressly prohibited, unless it is expressly allowed by the applicable domestic legislation for the purposes and under the limitations that such legislation provides. Any defect in the Fonts software is rectified by the licensor corporation Fonts.Gr following a relevant notification by the licensee. Any reproduction, sale, lease, loan, distribution, public presentation or digital dissemination, and free grant to a third party of the whole or a part of the Fonts software through analog or digital means and for the purposes of commercial exploitation of the software in question or a work or product generated by said software, is expressly prohibited. In view of the non-transferable nature of this license, any further grant of this license by the licensee to a third party is expressly prohibited. The licensee may only allow the use of the licensed software by a person employed or hired by him for the purpose of creating a work or product for the licensee. If the number of persons required to use the software is greater than the number of workstations covered by the license, further use of the software is possible only after an extension of the license. Such extension is granted for an additional fee by the licensor corporation Fonts.gr following a written request by the licensee determining the total number of workstations that need to be covered by the extended license (processors, workstations, printers and/or other devices, through which the software is used). This license does not allow the distribution of commercial products, e-books, e-publications, or applications (apps) which incorporate the Font software. For the publication, upload or distribution of e-books, applications or files for websites and electronic devices (portable devices, tablets, smartphones, etc.) incorporation the Font software, an extension of this license is required. Such extension is provided by the licensor corporation Fonts.gr following an agreement in writing and the payment of an additional fee. This license does not allow the embedding of the Font in a website, either through the @font-face CSS method or in any other way, or the use of the Font for the purpose of sending e-mail newsletters. This license does not allow the embedding of the Font in applications or games able to be reproduced and downloaded in electronic devices of any kind, in content that may be uploaded to online sharing platforms (such as YouTube, Facebook, TikTok, Instagram, etc.) or transmitted by television broadcasters, and in works or products destined to serve advertising purposes. Such extension of the license is provided by the licensor corporation Fonts.gr following an agreement in writing and the payment of an additional fee. Any use of the Fonts by the licensee in a logo, trademark, distinctive mark, product packaging or merchandise is allowed only after an agreement in writing and the payment of an additional fee to the licensor corporation Fonts.gr.
Derivative works A derivative work or product is one created by the licensee through the use of the licensed software or an autonomous portion thereof, including EPS files, PDF or vector files in general or other electronic works. Any use of the derivative works or products by the licensee is subject to the terms and conditions of this license. The commercial exploitation by the licensee of a derivative work or product, as an autonomous tradable good, is expressly prohibited. Indicatively, the sale, rental, lending, distribution, communication to the public by any analog or digital means and free grant to a third party of the derivative work or product generated by the licensed software is prohibited. Such use is possible only following an agreement in writing with the licensor corporation Fonts.gr and the payment of an additional fee, otherwise the licensee is liable for any damages caused to the licensor corporation Fonts.gr.
Limitation of liability The licensor corporation Fonts.Gr is not responsible or liable for any possible technical problems encountered by the licensee upon reproduction, download, upload, and use in general of the licensed software. Similarly, the licensor corporation Fonts.Gr is not responsible or liable for an acts or omissions of the licensee, his staff and collaborators or any third party while using the said software. The licensor corporation Fonts.gr is not responsible or liable for the unlicensed use, modification and/or adaptation of the software or its derivative works by the licensee or non-licensed third persons.
Termination In case of non-compliance by the licensee with any of the aforementioned terms, the licensor corporation Fonts.gr reserves the right to terminate without prior notice this license, resulting in the discontinuation of the use of the software. Any violation of the terms of this license may result in civil and criminal consequences in accordance with the Greek legislation and the international agreements on intellectual property protection.
Applicable law and jurisdiction This license and its provisions are subject to the laws of Greece. Any relevant dispute is resolved exclusively by the Courts of Athens, Greece.
