Fonts.Gr - Άδεια χρήσης γραμματοσειρών για Digital Ads

Η παρούσα άδεια χρήσης παρέχεται με τη λήψη (μεταφόρτωση) και εγκατάσταση του σχετικού λογισμικού Fonts.Gr (Ελληνική Ψηφιακή Τυποθήκη) στην ηλεκτρονική συσκευή του αδειούχου χρήστη, υπό την προϋπόθεση ότι ο τελευταίος αποδέχεται τους προδιατυπωμένους όρους χρήσης βάσει επιλογής, η οποία είναι ευκρινώς διαθέσιμη σε αυτόν.

Ορισμοί «Γραμματοσειρά» νοείται αφενός το κωδικοποιημένο λογισμικό που συνοδεύεται από την παρούσα άδεια χρήσης και παράγει ορισμένο σχέδιο και ορισμένη εικόνα όταν χρησιμοποιηθεί με τον κατάλληλο υλικό και τεχνολογικό εξοπλισμό και αφετέρου όλα τα λοιπά δεδομένα, συμπεριλαμβανομένης της τεκμηρίωσης η οποία παρέχεται με το εν λόγω λογισμικό. «Διάρκεια Χρήσης» νοείται η χρονική περίοδος ισχύος της παρεχόμενης άδειας. Ο αδειούχος επιλέγει στο κατάλληλο πεδίο τη διάρκεια ισχύος της άδειας, η οποία συναρτάται με τη διάρκεια της περιόδου διαφημιστικής προβολής του και τον επιθυμητό αριθμό εμφανίσεων (impressions).
Είδος και περιεχόμενο της άδειας Με την αποδοχή των όρων χρήσης ο χρήστης αποκτά μια χρονικά περιορισμένη, μη αποκλειστική και μη μεταβιβάσιμη άδεια χρήσης του λογισμικού των γραμματοσειρών για Digital Ads, υπό την έννοια ότι αποκτά δικαίωμα αναπαραγωγής και μεταφόρτωσης του συγκεκριμένου λογισμικού στον προσωπικό του ηλεκτρονικό υπολογιστή ή σε άλλη κατάλληλη ηλεκτρονική συσκευή, καθώς και το δικαίωμα χρήσης αυτού με σκοπό την παραγωγή έργου ή προϊόντος κατάλληλου για την προβολή της εμπορικής του δραστηριότητας. Η προβολή της εμπορικής δραστηριότητας του αδειούχου επιτρέπεται με τη χρήση του παραγόμενου έργου ή προϊόντος σε ψηφιακές διαφημίσεις κάθε είδους, σε διαφημιστικά πεδία που εφαρμόζονται στα κοινωνικά δίκτυα (ενδεικτικά αλλά όχι περιοριστικά σε Facebook, Instagram, YouTube, Tiktok και άλλα), σε διαδικτυακούς τόπους, σε οπτικοακουστικό περιεχόμενο (βίντεο) παραγόμενο από τον χρήστη, καθώς και σε διαφημιστικούς τίτλους, λογότυπα, σλόγκαν κλπ για την τηλεόραση, τον κινηματογράφο ή το διαδίκτυο.
Περιορισμοί της χρήσης Με την παραχώρηση της παρούσας άδειας χρήσης, ο αδειούχος δεν αποκτά δικαίωμα τροποποίησης, προσαρμογής, μετατροπής, μετάφρασης, διασκευής ή αλλοίωσης του λογισμικού των γραμματοσειρών με οποιονδήποτε τρόπο. Τυχόν σφάλμα στο λογισμικό αποκαθίσταται από την δικαιούχο εταιρεία Fonts.Gr κατόπιν σχετικής ειδοποίησης από τον αδειούχο. Απαγορεύεται ρητά κάθε ενέργεια αποσυμπίλησης ή ανακατασκευής του πηγαίου κώδικα ή του αντικειμενικού κώδικα του λογισμικού των γραμματοσειρών, εκτός εάν αυτό επιτρέπεται ρητά από ορισμένη εθνική νομοθεσία για τους σκοπούς που αυτή περιγράφει και με τους εκεί αναφερόμενους περιορισμούς. Απαγορεύεται ρητά η αναπαραγωγή, η πώληση, η εκμίσθωση, ο δανεισμός, η διανομή, η παρουσίαση ή η ψηφιακή διάθεση στο κοινό, καθώς και η δωρεάν παραχώρηση σε τρίτο φυσικό ή νομικό πρόσωπο του συνόλου ή τμήματος του λογισμικού των γραμματοσειρών με αναλογικά ή ψηφιακά μέσα και με σκοπό την εμπορική εκμετάλλευση του εν λόγω λογισμικού ή του παραγόμενου από αυτό έργου ή προϊόντος. Δεδομένης της μη μεταβιβαστής φύσης της παρούσας άδειας, απαγορεύεται ρητά η περαιτέρω παραχώρηση αυτής από τον αδειούχο σε τρίτο φυσικό ή νομικό πρόσωπο. Ο αδειούχος δύναται μόνο να παρέχει εξουσιοδότηση σε προστηθέντα αυτού ή άλλο πρόσωπο συνδεόμενο προς αυτόν με σύμβαση έργου ή εργασίας με σκοπό τη δημιουργία έργου ή προϊόντος με χρήση του λογισμικού των γραμματοσειρών. Κατ΄εξαίρεση επιτρέπεται η δημιουργία ενός μόνο αντιγράφου ασφαλείας του λογισμικού από τον αδειούχο.
Πνευματική και βιομηχανική ιδιοκτησία Όλα τα δικαιώματα πνευματικής και βιομηχανικής ιδιοκτησίας επί του λογισμικού των γραμματοσειρών και των αντιγράφων των οικείων αρχείων ανήκουν στην δικαιούχο εταιρεία Fonts.Gr βάσει της εθνικής, της ενωσιακής και της διεθνούς νομοθεσίας. Η παραχώρηση άδειας χρήσης δεν συνιστά εκχώρηση των απόλυτων και αποκλειστικών περιουσιακών εξουσιών της Fonts.Gr επί των γραμματοσειρών. Απαγορεύεται, επομένως, οποιαδήποτε ολική ή μερική αναπαραγωγή, μεταφόρτωση, δημοσίευση, διανομή, παρουσίαση στο κοινό, ψηφιακή διάθεση ή χρήση με κάθε τρόπο και μέσο του προστατευόμενου πρωτότυπου λογισμικού και των αντιγράφων αυτού για εμπορικούς σκοπούς. Ως δημοσίευση νοείται και η διάδοση του περιεχομένου του προστατευόμενου λογισμικού και των αντιγράφων αυτού από τα μέσα κοινωνικής δικτύωσης. Ως διανομή στο κοινό νοείται η διάδοση των υλικών φορέων που ενσωματώνουν το προστατευόμενο λογισμικό και τα αντίγραφα αυτού. Ως παρουσίαση στο κοινό και ψηφιακή διάθεση νοούνται οι πράξεις διάδοσης του προστατευόμενου λογισμικού και των αντιγράφων αυτού στο διαδίκτυο με οποιοδήποτε τρόπο. Επιτρέπεται μόνο η δημοσίευση, διανομή, παρουσίαση ή ψηφιακή διάθεση στο κοινό του έργου ή του προϊόντος που παράγεται με τη χρήση του λογισμικού των γραμματοσειρών.
Η διενέργεια μιας εκ των ανωτέρω πράξεων συνιστά προσβολή των δικαιωμάτων πνευματικής και βιομηχανικής ιδιοκτησίας της δικαιούχου εταιρείας Fonts.Gr, η οποία δύναται να διεκδικήσει κάθε θετική ή αποθετική ζημία σύμφωνα με τις διατάξεις της ισχύουσας ενωσιακής και εθνικής νομοθεσίας. Η δομή, η οργάνωση και ο κώδικας των γραμματοσειρών συνιστούν «επιχειρηματικό απόρρητο» της δικαιούχου εταιρείας Fonts.Gr και καλύπτεται από την υποχρέωση εχεμύθειας και την υποχρέωση μη ανταγωνισμού.
Παράγωγα έργα Ως παράγωγο έργο ή προϊόν νοούνται οι εικόνες, οι φράσεις, τα λογότυπα ή τα σύντομα διαφημιστικά μηνύματα (slogans) τα οποία δημιουργεί ο αδειούχος με χρήση του λογισμικού των γραμματοσειρών που καλύπτεται από την παρούσα άδεια ή αυτόνομου τμήματος αυτού. Απαγορεύεται ρητά η εμπορική εκμετάλλευση του παράγωγου έργου ή προϊόντος από τον αδειούχο ως αυτόνομο συναλλακτικό αγαθό. Ενδεικτικά απαγορεύεται η πώληση, η εκμίσθωση, ο δανεισμός, η διανομή, η παρουσίαση, η διάθεση στο κοινό ή η δωρεάν παραχώρηση του έργου ή του προϊόντος που συνιστά παράγωγο του λογισμικού που καλύπτεται από την παρούσα άδεια. Κατ΄ εξαίρεση επιτρέπεται η παραχώρηση κατά χρήση από τον αδειούχο στον αντισυμβαλλόμενο του έργου ή του προϊόντος που δημιουργείται από την εφαρμογή του λογισμικού των γραμματοσειρών με σκοπό την κατά προορισμό χρήση αυτού.
Κόστος Το κόστος της άδειας εξαρτάται από τον αριθμό εμφανίσεων (impressions) που ζητά ο αδειούχος. Εάν ο αριθμός των εμφανίσεων δεν είναι προκαθορισμένος, η άδεια μπορεί να αφορά σε περιορισμένο αριθμό εμφανίσεων με δυνατότητα επέκτασης αυτής και ανανέωσης της ισχύος της κατόπιν σχετικού αιτήματος του αδειούχου και καταβολής του αντίστοιχου αντιτίμου.
Περιορισμός της ευθύνης Το κόστος της άδειας εξαρτάται από τον αριθμό εμφανίσεων (impressions) που ζητά ο αδειούχος. Εάν ο αριθμός των εμφανίσεων δεν είναι προκαθορισμένος, η άδεια μπορεί να αφορά σε περιορισμένο αριθμό εμφανίσεων με δυνατότητα επέκτασης αυτής και ανανέωσης της ισχύος της κατόπιν σχετικού αιτήματος του αδειούχου και καταβολής του αντίστοιχου αντιτίμου.
Ισχύς Η διάρκεια ισχύος της παρούσας άδειας χρήσης και ο αριθμός εμφανίσεων του διαφημιστικού περιεχομένου αναγράφεται στο σχετικό τιμολόγιο.
Εφαρμοστέο Δίκαιο – Δωσιδικία Οι όροι της παρούσας άδειας υπόκεινται στις διατάξεις του Ελληνικού Δικαίου. Για οποιαδήποτε διαφορά προκύψει αποκλειστικά αρμόδια είναι τα Δικαστήρια της Αθήνας. Έκδοση DA1_2023

Fonts.Gr - User’s license for Digital Ads fonts

This user’s license is granted for the download and installation of the Fonts.Gr software in the licensee’s electronic device, on the condition that the licensee accepts and adheres to the standard terms of use through a selection method (button) clearly available to the user.

Definitions “Fonts” means the coded software, which is accompanied by the present user’s license and produces a specific design and a specific image when executed by the appropriate material and technological equipment, as well as all the other data, including the documentation provided with the software in question. “Term” means the period of time during which this user’s license remains in effect. The licensee selects at the appropriate field the duration of the license, which corresponds to the duration of the licensee’s advertising promotion and the desired number of impressions.
Type and content of the license By accepting the terms of use, the licensee acquires a limited-time, non-exclusive and non-transferable license to use the Fonts software for Digital Ads use, in the sense that s/he acquires the right to reproduce and download this particular software to her/his personal computer or other electronic device, as well as the right to use it for the purpose of creating a work or product to promote her/his commercial activity. The promotion of the commercial activity of the licensee is allowed through the use of the produced work or product in digital advertisements of any kind, in advertising fields offered by social media (including, but not limited to, Facebook, Instagram, YouTube, TikTok etc.), in websites, in audiovisual content (video) produced by the licensee, as well as in advertising titles, logos, slogans, etc. for television, motion pictures and the internet.
Limitations of use By acquiring this user’s license, the licensee does not obtain the right to modify, adapt, alter, translate, re-arrange or distort the Fonts software in any manner or form. Any defect in the Fonts software is rectified by the licensor corporation Fonts.Gr following a relevant notification by the licensee. Any act of decompiling or reverse-engineering of the source code or the object code of the Fonts software is expressly prohibited, unless it is expressly allowed by the applicable domestic legislation for the purposes and under the limitations that such legislation provides. Any reproduction, sale, lease, loan, distribution, public presentation or digital dissemination, and free grant to a third party of the whole or a part of the Fonts software through analog or digital means and for the purposes of commercial exploitation of the software in question or a work or product generated by said software, is expressly prohibited. Considering the non-transferable nature of this license, any further grant of this license by the licensee to a third party is expressly prohibited. The licensee may only allow the use of the Fonts software by a person employed or hired by him for the purpose of creating a work or product for the licensee. Exceptionally, the licensee may create a single back up copy of the Fonts software.
Intellectual Property
All intellectual property rights over the Fonts software and the relevant files belong to the licensor corporation Fonts.Gr as per the domestic, EU and international applicable legislation. The granting of a user’s license does not constitute a transfer of the absolute and exclusive property rights of Fonts.Gr over the Fonts. Consequently, any total or partial reproduction, download, publication, distribution, communication to the public or use of the protected original Fonts software and its copies in any manner or form and by any means for commercial purposes is prohibited. Publication includes the act of making the content of the protected software and its copies available to the public by electronic means of all kind including the social media. Distribution means the dissemination of the material support incorporating the protected software and its copies. Communication to the public means any act of dissemination of the protected software and its copies through the internet in any manner or form including acts of making available to the public in such a way that members of the public may access them from a place and at a time individually chosen by them. Only the publication, distribution, communication to the public or digital dissemination of the work or product generated by the licensor corporation Fonts.Gr are allowed. The performance of any of the aforementioned prohibited acts constitutes a violation of the intellectual property rights of the licensor corporation Fonts.Gr, which may seek damages and restitution in accordance with the applicable EU and domestic legislation. The structure, organization and coding of the Fonts software constitute a “business secret” of the licensor corporation Fonts.Gr and are covered by the obligations of non-disclosure and non-competition.
Derivative works
A derivative work or product is an image, phrase, logo or slogan created by the licensee through the use of the licensed Fonts software or an autonomous portion thereof. The commercial exploitation by the licensee of a derivative work or product, as an autonomous tradable good, is expressly prohibited. Indicatively, the sale, rental, lending, distribution, communication to the public by any analog or digital means and free grant to a third party of the derivative work or product generated by the licensed Fonts software is prohibited. Exceptionally, the licensee may grant to a third party the right to use Digital Ads software in order to produce the derivate work (image, phrase, logo or slogan) the creation of which is covered by this license.
Cost The cost of this license depends on the number of impressions requested by the licensee. If the number of impressions is not set, the license may concern a limited number of impressions and have an option of extension in terms of impressions or its Term, following the relevant request of the licensee and the payment of the corresponding cost.
Limitation of liability The licensor corporation Fonts.Gr is not responsible or liable for any possible technical problems encountered by the licensee upon reproduction, download, upload, and use in general of the licensed Fonts software. Similarly, the licensor corporation Fonts.Gr is not responsible or liable for an acts or omissions of the licensee, his staff and collaborators or any third party while using the Fonts software.
Term and number of impressions The Term of this license and the number of impressions are determined in the relevant invoice.
Applicable law and jurisdiction This license and its provisions are subject to the laws of Greece. Any relevant dispute is resolved exclusively by the Courts of Athens, Greece.
